Contractor asks for delay in trial

An attorney for a Dickinson-based contractor accused of federal income tax fraud wants more time to prepare for trial.

Fisher Sand and Gravel Co., Inc., and its vice president, Michael Fisher, have pleaded not guilty to conspiracy to defraud the government. Authorities say personal expenses for Fisher and other family members were being accounted for as business expenses in company records.

Defense attorney Tom Dickson of Bismarck is seeking to delay the Jan. 5 trial, saying the case is complicated and there's a large amount of evidence. A judge has not ruled on the motion.

The chief financial officer for the company, Amiel Schaff, pleaded guilty last month to one count conspiracy to defraud. His sentencing is set for March 30.
