FARGO (AP) - Prosecutors say the driver of a sport utility vehicle that struck and killed a construction worker in Cass County was suffering from a medical problem at the time of the crash and no charges will be filed.
The July 17 crash killed 26-year-old Benjamin Lenzen Jr., of Fargo. Authorities said he was beside an asphalt paver when the SUV drove around traffic and struck him and the equipment on a county road west of West Fargo.
Cass County State's Attorney Birch Burdick says the driver of the SUV, Russell Roberts of West Fargo, was experiencing a diabetes-related medical condition at the time of the crash.
Burdick's statement says that while Lenzen's death was tragic, criminal charges are not appropriate.
