Fargo wants lawsuit thrown out

FARGO (AP) - An attorney for the city of Fargo says a lawsuit by an Oregon truck driver and anti-abortion activist is frivolous and should be dismissed.

Robert Rudnick, of Bend, Ore., is suing the city over a $60 ticket he received more than three years ago for having obstructed windows on his minivan.

Rudnick, who refers to the vehicle as the "Truth Van," had pictures of aborted fetuses covering the rear-side windows and back window. He drove the van around Fargo during the 2004 election.

Police said Rudnick violated a city ordinance prohibiting people from driving vehicles with covered windows.

Rudnick says the city regulations are vague and the city violated his constitutional right to freedom of speech. In a response filed recently, city attorney Mike Miller said Rudnick has not made a valid case.
