Judge denies developer's appeal

GRAND FORKS (AP) - A judge has denied a developer's appeal of a Grand Forks County Commission decision to deny him a permit for a proposed landfill.

Judge Lawrence Jahnke said the commission's decision to deny John Scott's permit request last August appears to have been "rationally and reasonably made," based on the information presented.

The commission had voted 3-2 to deny a permit to Scott and the Red River Valley Solid Waste Disposal Facility company for a proposed site near Inkster, about 40 miles northwest of Grand Forks. The commission cited environmental reasons, including a high water table, wetlands and drainage issues, and the location along a beach ridge of Glacial Lake Agassiz.
