The North Dakota Supreme Court has scheduled a Nov. 17 hearing for the appeal of Moe Gibbs, who was sentenced to life without parole for killing Valley City State University student Mindy Morgenstern.
The former jailer and security guard was convicted last year of strangling the 22-year-old Morgenstern, of New Salem, in her off-campus apartment. Gibbs was convicted by a jury in Bismarck after jurors in his first murder trial in Minot declared a deadlock.
Supreme Court documents say Gibbs' appeal includes a challenge of DNA evidence in the case and arguments that the state did not provide enough funding for his defense.
