A Jamestown man has lost his third attempt to persuade the North Dakota Supreme Court to reopen his murder case.
Timothy Klose was convicted of killing his neighbor, Raymond Schultes, in March 2001.
The Supreme Court affirmed the conviction. Later, the justices also turned down Klose's petition to reopen the case.
Klose recently filed another petition claiming his attorneys did not do a good job of representing him. The Supreme Court rejected those arguments.
At his trial, Klose argued he was not responsible for the killing because he was suffering from alcohol withdrawal. He beat Schultes and shot him in the head with a shotgun.
