Two charged in child's death

GRAND FORKS (AP) - Charges have been filed against two people in connection with the death of a 2-year-old girl whose decomposing body was taken in a plastic container to Minnesota. Authorities on Wednesday declined to say how the child died.

Assistant Grand Forks County State's Attorney M. Jason McCarthy said in a statement that Jody Weaver, the mother of Destiny Weaver, was charged with two felony counts of abuse or neglect of a child, misdemeanor willful disturbance of a dead body and misdemeanor failure to report a death.

The statement from McCarthy said the abuse or neglect of a child charge alleges Jody Weaver did not properly care for her other two children "by allowing a deceased body to decompose in the minors' dwelling for approximately two weeks."

The other two children were placed in protective custody earlier.

If convicted on all charges, Jody Weaver would face more than 11 years in prison and $13,000 in fines.

Jody Weaver's boyfriend, Clarence Smith, who was from Grygla, Minn., is charged with misdemeanor willful disturbance of a dead body and misdemeanor failure to report a death. If convicted, he would face a maximum sentence of more than a year in prison and $3,000 in fines.

Authorities said Destiny Weaver had been dead for about two weeks when Jody Weaver and Smith put the toddler's body into a plastic container on Feb. 12, loaded it into the trunk of a vehicle and took it to Pennington County, Minn. Police said Smith called them during the trip and reported the body.

An autopsy was done. State's Attorney Peter Welte said Wednesday that his office would not comment on any details of the case, including the cause of death.
