Woman whose daughter died in 2005 suing hospital

GRAND FORKS (AP) - A woman whose 11-week-old daughter died in 2005 has filed a malpractice lawsuit against Altru Hospital, saying doctors failed to diagnose the infant's broken ribs and other medical problems.

Altru is seeking to dismiss the complaint filed by Angela Baker, saying Baker did not prove she was entitled to damages. She is seeking at least $50,000.

Grand Forks police said they were called on Oct. 8, 2005, after McKenzie Hammond stopped breathing.

The baby's father, Tyson Hammond, was acquitted by a jury in September on charges of murder and child abuse.

Prosecutors said during the trial that McKenzie's rib fractures showed a pattern of abuse by Hammond. A doctor who testified for the defense said the broken ribs likely were caused from childbirth.

Baker's lawsuit said Altru doctors "failed to diagnose the cause or causes of McKenzie's feeding problem and apparent pain, including multiple rib fractures."
