Standing Rock election matter goes to court

Avis Little Eagle wants a tribal court judge to decide whether she should have another chance to be on the September ballot for Standing Rock Sioux tribal chairman.

A hearing on the matter will be held at 10 a.m. today in tribal court on Little Eagle's case for election misconduct.

Little Eagle, who is the tribal vice chairman and hopes to become the first elected female leader, was edged out of the race last month, coming in third in a primary election recount.

Chairman Ron His Horse Is Thunder beat her by one vote. Unless anything changes before the final election, he'll go on to face former tribal chairman Charles Murphy, who was the runaway primary winner.

The tribal election commission upheld the recount and Little Eagle's next recourse is tribal court, where she's asking the judge to either name her the rightful candidate, or to schedule a runoff between her and His Horse Is Thunder.

In her complaint, Little Eagle says that two disabled voters and the wife of one of them were not allowed to vote for her.

In the case of one of the disabled voters, Little Eagle said election workers have taken a ballot out to his car in past elections, but refused to do so this time. She said by the time he and his wife went home for a wheelchair and returned, the poll had closed.

She calls his "the single vote that would have tied the election results," and said tribal election law was violated in his case.

Little Eagle claims another supporter, who is a quadriplegic, was denied an absentee ballot, though he's voted in absentia in past elections.

Her complaint also names five people who voted in the primary election despite not having residency on the reservation.

The tribal election commission, His Horse Is Thunder and the three voters she claims were wrongfully denied access to ballots have all been subpoenaed to today's hearing.

Dellis Agard, who heads the tribal election office, was not available to comment for this story. His Horse Is Thunder did not return phone calls for comment.
