A jury has found a Center man guilty of two counts of aggravated reckless driving for an April 2006 collision that killed a Mandan man.
Dale Lee Cahoon, 35, was convicted of the two Class A misdemeanors on Thursday at the Morton County Courthouse by a six-member jury.
Cahoon, who lived in Bismarck at the time of the crash, also faces an infraction charge of failure to render aid at an accident scene, which will be resolved later at a bench trial before South Central District Judge Bruce Haskell. Morton County State's Attorney Allen Koppy said infractions are not tried by a jury, so it was not included in the Thursday trial.
Neal L. Geiger was killed and JoLynn A. Lefor was injured when Geiger's motorcycle struck Cahoon's pickup after Cahoon failed to yield at a stop sign about five miles west of Mandan.
According to the North Dakota Highway Patrol, Cahoon's pickup pulled into the intersection after it stopped, but it failed to yield to the eastbound motorcycle. The motorcycle struck the right fender of the pickup, causing the driver and passenger to be thrown from the bike.
Koppy explained that aggravated reckless driving means reckless driving that results in injuries and does not refer to road-rage incidents.
He said Cahoon voluntarily went to the hospital for a drug and alcohol test following the crash. "It came back negative for everything," he said.
Koppy said Lefor has returned to her job. Koppy did not know exactly what her injuries entailed, but "Ms. Lefor did suffer fractures to her lower extremities," he said.
The jury took about an hour to return the guilty verdicts, Koppy said.
Cahoon will be sentenced at a later date, following a presentence investigation. He faces up to one year in prison and fines of up to $2,000 for each conviction of aggravated reckless driving.
If convicted of failure to render aid at an accident scene, Cahoon could be ordered to pay fines of up to $500.
