Charges may not come soon in fatal auto crash

The decision on whether to file charges against a driver involved in a fatal Bismarck crash may not come quickly, a Burleigh County prosecutor says.

Burleigh County Assistant State's Attorney Lloyd Suhr, who was assigned the case, said he has to review the reports of the collision; then, a follow-up investigation may have to be done before charges can be filed.

"Obviously, we want to make sure that all of the necessary investigation has been completed,"he said.

Roy Roberts, 39, died at 6:27 p.m. Saturday at Medcenter One due to injuries suffered in a crash March 20 in east Bismarck, said Lt. Dan Donlin.

Roberts was taken by ambulance to the hospital shortly after 8 p.m. March 20 after a 2001 Oldsmobile driven by a 16-year-old girl collided with his 1995 Ford Explorer.

Acording to police, witnesses said the girl ran a red light while going north on Expressway. Roberts was going west on Main Avenue through the intersection.

The 16-year-old girl and her passenger were taken to St. Alexius hospital, as was Roberts' passenger. All three were treated for minor injuries and released.

Police have not released the name of the 16-year-old girl, because charges possibly could be filed against her.

Traffic charges could be filed in Bismarck Municipal Court, or criminal charges could be filed in South Central District Court or in juvenile court. Charges filed in juvenile court are not public record, and proceedings are confidential.

Suhr said he does not know yet what kind of charges could be filed or in which court potential charges could be handled.

"Because it does involve a juvenile … it would depend upon the nature of the charges being filed," he said.
