BISMARCK, N.D. (AP) - North Dakota's Supreme Court says it won't intervene in the Moe Gibbs murder case.
Prosecutors wanted the high court to order Southeast District Judge John Paulson to allow them to introduce evidence of Gibbs' possible motive. He is accused of killing Valley City State University student Mindy Morgenstern in September 2006.
The Supreme Court issued a one-page order denying the request.
Prosecutors say the killing may have resulted from an attempted sexual assault that escalated into murder. Paulson says there's no evidence at the crime scene that the killing was sexual in nature.
