A former Burleigh County sheriff's deputy plans to go to trial on a charge of failure to appear.

Ron Dietz maintained his not guilty plea to the Class Amisdemeanor Monday at the Burleigh County Courthouse.

Dietz is accused of failing to appear to testify at a trial on Nov. 13. Prosecutors have said he was the sole witness in the minor in possession case, which was dismissed when he did not show up for the trial.

Dietz now works in the Coon Rapids, Minn., Police Department.
