A Bismarck man will spend 10 days in jail for hitting a man on a motorcycle with his car and driving away.
Francis Red Tomahawk, 24, pleaded guilty on Monday to violating an order prohibiting contact, leaving the scene of an accident involving injury, driving under the influence, driving under suspension and no liability insurance.
South Central District Judge Sonna Anderson sentenced Red Tomahawk to 30 days with all but 10 suspended and $325 in court fees for violating an order prohibiting contact; 10 days for leaving the scene of an accident; $250 fine and 10 days suspended for driving under the influence; 10 days for driving under suspension; and $150 for no liability insurance.
Burleigh County Sheriff's Deputy Nick Sevart said a deputy was sitting at the light at Bismarck Expressway and Washington Street and witnessed a northbound vehicle strike a motorcycle that was turning left onto Expressway at 9:09 p.m. Saturday.
Bismarck Police Lt. Randy Ziegler said the motorcyclist, a 43-year-old Bismarck man, hit the car's windshield and his helmet was damaged. He was taken to a hospital for unspecified injuries. Witnesses heard the driver of the vehicle yell "sorry," Ziegler said.
The motorcyclist was able to stand up and get the license plate number, Ziegler said.
The sheriff's deputy pursued the vehicle and stopped it in a nearby parking lot. Sevart said Red Tomahawk was driving the vehicle, and he was prohibited by court order from contacting one of the passengers in the vehicle.
Burleigh County Assistant State's Attorney Cynthia Feland said Red Tomahawk was swaying as he got out of the vehicle, and he failed field sobriety tests. Results of a blood test had not come back yet, she said.
Red Tomahawk said the woman he was prohibited from contacting told him the order had been dropped, and they were going to her apartment so he could see papers she said she had on the matter. He said he "panicked" and left the scene of the accident.
Anderson said Red Tomahawk can report back to the jail on Friday to continue serving his sentence. She said she will allow him work release if he qualifies for it; if he does not qualify, he will serve his sentence over weekends.
