His release from jail accidental

A Bismarck man charged with two felonies Monday was accidentally released from jail before making his first appearance before a district judge.

Conan Moore, 28, was charged in South Central District Court Monday with felonious restraint and unauthorized use of a motor vehicle, both Class C felonies.

Moore had pleaded not guilty earlier Monday to simple assault, a Class B misdemeanor, in Bismarck Municipal Court.

Bismarck Police Sgt. Mark Buschena said a 23-year-old Bismarck woman called police at 6:30 p.m. Sunday to report that her ex-boyfriend had punched her in the face while at a south Bismarck video store. The woman said her ex-boyfriend, Moore, then forced his way into her vehicle and drove her east of Bismarck against her will, Buschena said.

The woman said she cooperated with Moore to avoid getting hurt, and he later brought her back to the video store, Buschena said.

He said Moore was arrested at his workplace later Sunday evening. Moore was placed in the Burleigh County Detention Center at 10 p.m. Sunday.

Moore was released from the Burleigh County Detention Center at 11:45 a.m. Monday after his municipal court appearance.

Moore was supposed to make a 3:30 p.m. appearance before South Central District Judge Bruce Haskell on the felony charges. At the appearance, Moore would have been informed of the charges he is facing and a bond would have been set.

However, municipal court and Burleigh County Sheriff's Department authorities were unaware of the pending district court charges against Moore, so they released him.

"Our records only indicate that he had a city charge," said Sheriff's Major Nick Sevart.

Burleigh County Assistant State's Attorney Pamela Nesvig said felony complaints charging Moore with the additional crimes were not signed until early Monday afternoon. She said a warrant would be issued for Moore's arrest.
