More arrests made in connection with homicide investigation

Alden J. Fast Horse appears to have been the victim of three crimes last week - burglary, robbery and homicide.

More arrests have been made for the additional crimes discovered during the course of the homicide investigation, but no one has been implicated directly in the Cannon Ball man's death.

Fast Horse, 30, was found dead in a hotel room at the Ramkota Inn, 800 S. Third St., at 12:03 p.m. Thursday. Police said Fast Horse had been stabbed.

Burleigh County Assistant State's Attorney Cynthia Feland said a burglary was the first crime that occurred in room 3170.

Leland Bad Brave, 21, was charged Monday with Class Bfelony burglary. James Wisbey, 22, was arrested and charged last week for the same offense.

Bad Brave also was charged in connection with the second crime alleged to have occurred in the hotel room - an armed robbery. He and Elena Vassar, 22, were charged Monday with Class Afelony conspiracy to commit robbery.

Feland explained "conspiracy to commit robbery" is the same level of offense as robbery. The difference, to prosecutors, is that a conspiracy can be a group effort. The people charged in a conspiracy case can be found guilty if they are involved in any of the overt acts that constitute the conspiracy.

"They all don't have to commit the acts," Feland said.

Six overt acts are alleged in the cases against Bad Brave and Vassar, according to court documents. The acts alleged are driving to the Ramkota, obtaining weapons, entering the Ramkota, entering room 3170, striking Fast Horse and "directing the force of a dangerous weapon against Alden Fast Horse."

The dangerous weapon alleged to have been used on Fast Horse was a knife, Feland said. She said the charges do not mean that either Bad Brave or Vassar are accused of being the ones who used the knife on Fast Horse. Other people may still be charged in the conspiracy.

"There may be others,"she said.

Feland said she cannot comment yet on the timing of the robbery in relation to the homicide or whether Fast Horse was killed in the course of the robbery.

South Central District Judge Robert Wefald set bond for Bad Brave at $80,000 cash on Monday. The judge set bond for Vassar at $30,000 cash. At the request of Feland, Wefald prohibited Bad Brave and Vassar from using or possessing alcohol if released.

"Alcohol was a factor in these cases," Feland said.

Wisbey also remains in the Burleigh County Detention Center in lieu of $5,000 cash bond and is prohibited from using or possessing alcohol if released.

Wisbey was one of two men seen with Fast Horse on a hotel surveillance tape prior to Fast Horse's death. Police released the surveillance photos Thursday night and were able to find the two men due to tips from the public. Both men were questioned, and Wisbey was held for the burglary. The other man, who has not been identified, was released after questioning.

Police have said Fast Horse was in Bismarck to visit family. He had checked in at the Ramkota on Monday, but police do not know how long he planned to stay. A Ramkota employee found Fast Horse unresponsive when an acquaintance showed up to give Fast Horse a ride on Thursday. Police and emergency personnel arrived on scene, then detectives were called to investigate.

Police continue to look for Sheldon McHugh, 19, whom they consider a "person of interest" in the case. McHugh's name came up in the course of the investigation, and detectives would like to speak with him. McHugh, of Bismarck, is described as 5-feet-8-inches tall, about 150 pounds, with brown hair and brown eyes.
