Todd Alen Dailey, Mandan, entered a not guilty to manslaughter and felony driving under the influence charges Monday in South Central District Court, according to Kidder County State's Attorney Robin Thompson Gordon.
Dailey, 28, waived a preliminary hearing and at the arraignment pleaded not guilty to charges relating to a collision involving himself and Alice Olson, 67, of Sterling. Dailey rear-ended Olson's 1998 GMC Jimmy on Interstate 94 a couple of miles east of Steele, according to the North Dakota Highway Patrol. Gordon said tests show Dailey had a blood alcohol level of 1.2.
Olson, 67, was ejected from her vehicle after it went into the ditch and rolled. The Sterling woman was pronounced dead at the scene, and Dailey was taken to a Bismarck hospital. Neither was wearing a seatbelt.
A trial date hasn't been set, Gordon said. The manslaughter charge is a class B felony punishable by 10 years imprisonment and the DUI is a class C felony punishable by five years imprisonment. Dailey was released from jail after posting a $10,000 cash or surety bond.
