Men plead guilty to charges

A Bismarck couple and a Colorado man have pleaded guilty to multiple drug charges from January.

Christopher Tokach, 31, and Christopher Harris, 60, entered guilty pleas to South Central District Judge Tom Schneider Wednesday morning to multiple drug charges.

Christopher Tokach pleaded guilty to charges of possession of methamphetamine with intent to deliver, possession of ecstasy with intent to deliver, felony and misdemeanor counts of possession of drug paraphernalia, possession of less than one-half ounce of marijuana and resisting arrest.

Harris, of Colorado, pleaded guilty to charges of possession of drug paraphernalia, conspiracy to deliver methamphetamine, conspiracy to deliver ecstasy, delivery of methamphetamine, delivery of ecstasy, delivery of drug paraphernalia, and possession of methamphetamine.

Amber Tokach, 24, pleaded guilty on Aug. 22 to charges of possession of methamphetamine with intent to deliver, possession of ecstasy with intent to deliver, felony and misdemeanor counts of possession of drug paraphernalia, and possession of less than one-half ounce of marijuana.

Schneider sentenced Christopher Tokach to 20 years, with 10 years suspended and five years of supervised probation, for the charges of possession of methamphetamine with intent to deliver and possession of ecstasy with the intent to deliver. The judge also sentenced him to five years in prison for possession of drug paraphernalia and resisting arrest, one year for misdemeanor possession of drug paraphernalia and 30 days for possession of marijuana, Burleigh County Assistant State's Attorney Ty Turner said. He said Christopher Tokach also has to pay court fees.

Schneider sentenced Harris to a five-year deferred imposition of sentence and a $10,000 fine for all the charges he faced, Turner said. A deferred imposition of sentence means Harris will not have the offenses on his record if he successfully completes probation.

Schneider sentenced Amber Tokach in August to 10 years, with five years suspended and five years of supervised probation, for possession of methamphetamine with intent to deliver and possession of ecstasy with the intent to deliver. The judge also sentenced her to five years in prison for felony possession of drug paraphernalia, one year for misdemeanor possession of drug paraphernalia and 30 days for possession of marijuana, according to court documents.

Turner said the sentences were agreed upon by prosecutors and defense attorneys because all three cooperated with law enforcement in providing drug information. The prison sentences for the Tokaches will run concurrent.

During a preliminary hearing for Christopher and Amber Tokach in April, Bismarck Police Detective Cody Trom said he received information that drugs were being trafficked out of the Tokach home on the 500 block of South 12th Street. He and his partner saw a rented vehicle with Colorado plates in the driveway, which later turned out to be driven by Harris.

Harris was pulled over in that vehicle after an officer witnessed several traffic violations. Police found methamphetamine on Harris, and a search of the car revealed more than $10,000 in cash, Trom said. He said a later search of the vehicle also turned up an "owe sheet," which Harris said included items he had sold to the Tokaches.

The "owe sheet" said Harris sold them 17 ounces of methamphetamine, 20 hits of ecstasy, a chip container with a false bottom, new methamphetamine pipes with padded cases, and urine kits, Trom said.

Trom said they found methamphetamine, ecstasy, urine kits, a scale, drug paraphernalia and several containers with false bottoms in a search of the Tokach home. They also found an "owe sheet" identical to the one in Harris' vehicle, he said.

Police found about 1 ounce of methamphetamine, he said.
