A Sterling man has been charged with gross sexual imposition for allegedly raping a developmentally disabled woman.
Jeff Mosbrucker, 33, was charged Tuesday with the Class A felony, and a warrant was issued for his arrest.
South Central District SJudge David Reich set a bond of $10,000 cash for Mosbrucker Friday at the Morton County Courthouse.
If convicted, Mosbrucker could spend up to 20 years in prison and pay fines of up to $10,000.
According to an affidavit from Morton County Sheriff's Deputy Jerry McClure, deputies responded to reports of an 18-year-old Morton County woman who had been raped on Aug. 2.
The woman said Mosbrucker had sex with her twice, and she said she had told him to stop both times, the affidavit said.
The affidavit said a child psychologist reported the woman has developmental disabilities that would prevented her from understanding what happened even if she had consented.
The criminal complaint, signed by McClure, said, "The defendant had reasonable cause to believe that the victim suffered from a mental disease or defect which rendered her incapable of understanding the nature of her conduct."
Mosbrucker has past convictions for various offenses including simple assault, criminal trespass, theft of property, and drug possession.
He is currently facing charges in Burleigh County of two counts of possession of drug paraphernalia, one a Class Cfelony and one a Class A misdemeanor, according to court documents.
Mosbrucker is slated to appear at a revocation of probation hearing in Burleigh County on Dec. 1, documents say. He was convicted of possession of marijuana by a driver, two counts of possession of drug paraphernalia, possession of oxycodone, possession of codeine, and possession of hydrocodone, and a judge will determine whether his probation should be revoked on those convictions
