Man sues Walsh County officials over wife's death

FARGO, N.D. (AP) - The husband of a woman who died in the Walsh County Jail in 2004 is suing county officials, saying they should have monitored her.

Carey Peltier, of Belcourt, filed the civil lawsuit in federal court against Walsh County, Sheriff Lauren Wild and three unnamed jail employees over the death of his wife, Sonja. The sheriff and employees face claims in both their individual and professional capacities.

Sonja Peltier, 53, of Belcourt, was arrested on suspicion of drunken driving late on Oct. 2, 2004, and was found dead in her jail cell in Grafton early the next morning. The lawsuit filed by her husband says inmates heard her yelling for help before she died about 4:30 a.m.

The lawsuit claims jail employees should have protected and monitored Sonja Peltier. It also alleges that Wild and the county failed to properly train employees to handle inmates who are injured or dangerous to themselves.

Wild said the North Dakota Bureau of Criminal Investigation looked into Sonja Peltier's death. The sheriff said he could not comment about the death or the lawsuit.

The North Dakota Attorney General's Office, which oversees the BCI, provided a copy of the state forensic examiner's report that found Sonja Peltier died of heart disease. The autopsy report also said she also suffered from chronic obstructive pulmonary disease and chronic alcoholism.

Carey Peltier's lawsuit seeks more than $150,000.

Walsh County Assistant State's Attorney Sarah Cannon said the lawsuit has been referred to the North Dakota Insurance Reserve Fund, which provides coverage and legal assistance.
