A Bismarck couple has been charged with two counts of abuse or neglect of a child, Class Cfelonies, after police found them intoxicated while their two children were in their custody.
Paul and Crystal Hoiland also were charged with possession of a controlled substance, a Class Cfelony, possession of drug paraphernalia associated with marijuana, a Class A misdemeanor, and possession of less than a half-ounce of marijuana, a Class B misdemeanor.
South Central District Judge Robert Wefald set bond for Paul Hoiland, 33, at $10,000 cash or surety, and Wefald set bond for Crystal Hoiland, 28, at $1,000 cash or surety.
Wefald also prohibited the Hoilands from possessing or consuming alcohol or having contact with their children unless the contact is through Burleigh County Social Services.
Bismarck Police Sgt. Mark Buschena said police responded to a noise complaint at an apartment on the 2000 block of North 14th Street at 1:59 a.m. Sunday. Complainants said the television in the apartment could be heard down the hallway, Buschena said.
He said no one would open the door when police arrived, so they called the apartment manager to have the door opened.
Officers found both adults in the apartment passed out from alcohol intoxication, Buschena said. Two children were in the apartment, he said.
Burleigh County Assistant State's Attorney Lloyd Suhr said the children, a 4-year-old girl and a 2-year-old boy, are in the custody of Burleigh County Social Services.
Suhr recommended bond for Crystal Hoiland be set at $3,000 cash or surety and bond for Paul Hoiland be set at $3,000 cash. Suhr said both have criminal histories, but Paul Hoiland's consists of more serious offenses, including a 1993 escape conviction.
