A Bismarck library clerk has been charged in federal court with one count of traveling with the intent to engage in illicit sexual conduct with a minor.
David Boschee, 37, was charged for allegedly traveling to South Dakota on Sept. 29, 2006, for the purpose of engaging in illicit sexual conduct with a minor, said a news release from U.S. Attorney Marty Jackley from the district of South Dakota.
The charge is punishable by up to 30 years in prison and fines of up to $250,000.
United States Magistrate Judge Charles S. Miller ordered on Monday that Boschee be held until he can be transferred to South Dakota. Boschee was being held in the Burleigh County Detention Center as of Tuesday afternoon.
A trial date has not yet been scheduled.
According to an affidavit written by Federal Bureau of Investigation Agent Michelle Behan, Sioux Falls Police Detective Andrea Kelly informed her on Jan. 25 that Boschee had met a 15-year-old Sioux Falls girl over the Internet. Both of them had Myspace.com profiles, the affidavit said.
The girl's birth date was on her profile, identifying her as a 15-year-old girl, the affidavit said.
Boschee and the girl began e-mailing and chatting with each other online, the affidavit said.
"Some of the conversations were sadomasochistic in nature," Behan wrote.
The affidavit said Boschee and the girl planned to meet for sex in Sioux Falls, but the girl changed her mind a week before he came. However, he allegedly went to Sioux Falls anyway and paid for a room at the Super 8 in Sioux Falls with a credit card, the affidavit said.
The girl told police she had sex with him at the motel, the affidavit said.
Miller wrote in an order filed Tuesday that Boschee will be held because evidence suggests he is a flight risk and a danger to the community.
"This evidence includes: the defendant's itinerant history and tenuous ties to both the district of the offense and the district of the arrest," the order said. It also said there was evidence that Boschee suffers from depression.
"While the defendant has family that lives in Bismarck and he is employed at the Bismarck Public Library, he is single and has spent considerable time in the past out-of-state," Miller wrote.
Bismarck Police Lt. Dan Donlin said the FBI out of Sioux Falls and the North Dakota Bureau of Criminal Investigations requested that the police department assist in locating Boschee Monday morning.
Police first checked Boschee's home on the 900 block of North 13th Street, then found him at the Bismarck Public Library, at 515 N. Fifth St., Donlin said.
Library director Tom Jones said Boschee started a part-time position as a clerk at the circulation desk of the library in August. He has worked 20 to 23 hours per week in a highly visible position in which he was always with other staff members, Jones said.
"I'm not aware of any misconduct while he was here," Jones said.
Jones said no action has been taken regarding Boschee's employment at the library, and Boschee has not resigned his position.
Donlin said Boschee was taken to the police department for questioning, then was placed in the custody of the U.S. Marshal.
A search warrant was executed on Boschee's residence later Monday, the news release said.
The news release said the case is being investigated by the FBI, Sioux Falls Police Department, Bismarck Police Department and North Dakota Bureau of Criminal Investigation.
The case also is part of U.S. Attorney General Alberto Gonzales's Project Safe Childhood, a nationwide initiative designed to protect children from online exploitation and abuse.
