18-year-old faces GSI rap for acts with 13-year-old

An 18-year-old man has been charged with gross sexual imposition for performing sexual acts on a 13-year-old Mandan girl.

Jamie George Schick, 18, was charged Friday with two counts of Class C felony gross sexual imposition for allegedly having sex with the girl in January and performing a sexual act on her in March, according to court documents.

The penalty for having sex with someone under 15 is a Class A felony for anyone more than four years older than the victim. However, during the last legislative session, the North Dakota Century Code was amended to make the penalty a Class C felony for anyone more than four years but less than five years older than a victim.

Schick is four years and 193 days older than his victim, according to court documents.

Schick could serve a maximum of five years in prison for both counts and pay up to $5,000 in fines for both counts.

Schick's address is now listed in Bismarck, and the events allegedly occurred at two different addresses in Mandan.

Mandan Police Detective Dave Shipman said the incidents were first reported by a junior high school counselor who heard about them from friends of the victim. The victim told Mandan Police Lt. Paul Leingang about what had happened on March 10, according to court documents.

Leingang is out of town and could not be reached for comment.

The girl, who is now 14, allowed Leingang to monitor a telephone call between her and Schick, an affidavit from Leingang said. The girl told Schick during the conversation that her cousins didn't believe her when she told them that they had sex on two occasions, the affidavit said.

"Jamie Schick replied, 'It was great,'" the affidavit said.

The victim also asked Schick if he was going to make her have sex, and he said yes, the affidavit said.

North Dakota has a one-party consent law concerning recorded telephone calls, so Schick did not have to be told that the call was being recorded, Shipman said.

A 14-year-old male witness told Leingang that Schick bragged about having sex with the girl, the affidavit said.

A 14-year-old female witness said she saw Schick and the victim go into another room the night of the January incident, and she followed them a few seconds later and saw that the lights had been turned off, the affidavit said.

South Central District Court Judge Sonna Anderson set Schick's bond at $10,000 Monday.
