Mandan teen charged for alleged rape

A Mandan teenager has been charged with gross sexual imposition for allegedly having sex with an unconscious woman.

Brandon Gosch, 18, was charged Thursday with the Class Afelony.

South Central District Donald Jorgensen set bond at 10 percent of $10,000 for Gosch Friday at the Morton County Courthouse, Morton County State's Attorney Allen Koppy said. He said Gosch is prohibited from having contact with the alleged victim.

Gosch is accused of having non-consensual sex with an 18-year-old Mandan woman while she was passed out from alcohol consumption at a party at Gosch's home in Mandan on Sept. 1. He was arrested Thursday night at the Bismarck business where he works.

Gosch's attorney, Paul Myerchin, was out of the office on Friday, a receptionist at his law office said.

Mandan Police Detective Jon Vanderhoef said the party was attended by a group of teenagers who had grown up together in Mandan and had graduated from high school in May.

The 18-year-old woman said she passed out in Gosch's bed around 2 a.m. Sept. 1, according to court documents. She told officers she remembers Gosch being under the covers of the bed with her and remembers telling Gosch to stop rubbing her stomach and trying to unbutton her pants.

The woman said she remembers getting out of the bed and putting on her shoes but has no further memories until she woke up in her own bed at 12:30 p.m., documents said. She realized she had injuries when she woke up, and on Sept. 3 a sexual assault nurse examiner said the injuries were consistent with non-consensual sex.

Court documents say Gosch has denied having sex with the woman. Other people present at the party who have been interviewed by police said the woman was intoxicated to the point that she was mumbling when trying to talk and later passed out, court documents said. One witness told police the woman, while intoxicated at the party, told him Gosch made her kiss him.
