Bismarck man gets suspended sentence

A Bismarck man has received a suspended sentence for an aggravated assault charge related to stabbing his brother with a utility knife.

South Central District Judge David Reich sentenced Kenneth Painte, 34, to one year with all but time served suspended and three years of supervised probation.

Painte also has to complete a domestic violence treatment program while on probation and pay $550 in court fees.

Painte pleaded guilty on Oct. 1 to aggravated assault. He had been accused of cutting his brother, Ashton Painte, with a utility knife in July after they had been drinking in Kenneth Painte's apartment.

Ashton Painte was treated and released at a Bismarck hospital and then was arrested on a warrant out of Burleigh County for a petition for revocation of probation.

Kenneth Painte was arrested at his apartment.

Burleigh County Assistant State's Attorney Pam Nesvig suggested a suspended sentence because Painte has no other recent offenses on his criminal history. Wayne Goter, Painte's appointed defense attorney, requested a deferred sentence.
