The Tree City Bar of Mandan followed the Silver Dollar Bar's lead early Friday and got an injunction and restraining order against the city of Mandan.
Tree City will continue providing adult entertainment at least until July 19, when representatives from the bar and Mandan will appear in district court. Here, they will present arguments to District Judge Don Jorgensen, who will determine if the restraining order will continue.
The restraining order regards ordinances 961 through 964, which call for a separation of alcohol sales and adult entertainment. The ordinances also ban adult entertainment from downtown areas. All three adult businesses in Mandan are on Main Street.
On Thursday, the Silver Dollar got a restraining order against the city.
Mandan Police Department Chief Dennis Rohr said that right now the city can't enforce the ordinance and the bars can still offer adult entertainment.
Tree City is owned and operated by the McCrothers Corp. The bar has been open since 1991 and has offered adult entertainment since then.
The Bookstore of Mandan received an extension from the city commission to continue operating until the end of August. According to court reports, McCrothers Corp. president Stephanie Kraft said that discriminates against Tree City.
Kraft also said in the report that the corporation believes the ordinance should not apply to businesses that were already open at the time it was introduced.
Kraft and other Tree City managers refused to comment about the restraining order.
Mandan city administrator Jim Neubauer said the city's goal is to separate alcohol sales from adult entertainment.
"We also want to move that kind of entertainment to a more industrial area instead of downtown," he said.
Neubauer said there is no action they can take until after July 19.
"There's nothing we can do but let this run its course," Neubauer said. "There's not a big hullabaloo or anything."
