Probe into fatal crash nearly over

An investigation into the accident on Highway 85 near Fairfield that killed three men in one car and the driver of a loaded oil tanker truck should wrap up this week.

Capt. Tony Huck of the North Dakota Highway Patrol said he'll take the investigation results to Billings County State's Attorney Jay Brovold, who will determine whether any charges should be filed.

It'll be up to the state's attorney to make that determination, and earlier reports that implied charges would be filed were premature, Huck said.

Brovold is out of his office at the Billings County Courthouse at Medora until Thursday and not available for comment.

He'll have to decide whether there's any criminal outcome of the June 20 accident that caused the death of two rural Amidon brothers, their friend and the truck driver.

Funerals for Justin Jacobson, 25, Casey Jacobson, 19, and Brandon Klein, 20, of Bowman, were held Thursday, with a community memorial service Friday.

A funeral for Don Tucker, 46, of Grassy Butte, was held Monday at Grassy Butte.

The Jacobsons and Klein were passengers in a car driven by a third Jacobson brother, Ryan, who remains hospitalized.

Ryan Jacobson, 21, apparently fell asleep and swerved over the center line, causing a head-on collision with Tucker's truck.

The oil truck jackknifed on the highway and burned for hours. Tucker escaped his truck on his own but succumbed to burn injuries the next morning.

The young men were on their way home from a rodeo. Tucker was at work, hauling an oil load from a well site near Fairfield.
