Johnny Lerma, 37, of Mandan, entered not guilty pleas Monday to charges of possession of marijuana with intent to deliver, a Class B felony, and driving under suspension, a Class B misdemeanor.
Around 5 p.m. April 17, Lerma was pulled over on the side of Interstate 94 with smoke rolling out of the hood of the car he was driving when Sgt. Jim Halm, a Burliegh County sheriff's deputy, stopped to see what was wrong.
After he discovered the car was not in Lerma's name and that he had a suspended license, Halm went to open the hood of what he described as an overheated vehicle, to let it cool off.
When he opened the hood, he noticed a bag shoved against the vehicle's air intake, filled with 14 baggies of marijuana ranging in weight from 1.69 grams to 5.23 grams.
Lerma could face 10 years of imprisonment and up to $10,000 fines if found guilty.
Lerma remains in jail on a $10,000 bond.
