Riding a bike while intoxicated is still considered driving drunk, police say.

A Bismarck man was arrested Thursday morning at 9:45 after he lost control of his bicycle and tipped over. A passerby noticed he was not moving and contacted the police and Metro Ambulance, police said.

When Metro arrived, the man declined help and attempted to flee. Police arrested him for driving under the influence.

Under North Dakota law, a bicycle or ridden animal can be considered a vehicle.
