Long to serve four years in jail

A second teenager has been sentenced for involvement in a September burglary and a robbery.

South Central District Judge David Reich sentenced Henry Long, 18, on Wednesday to serve four years in prison for five felony charges.

Reich sentenced Long to five years with all but two years suspended and five years of supervised probation for Class Cfelony burglary and Class C felony theft of property. Those sentences will run concurrent to each other.

Reich sentenced Long to 10 years with all but two years suspended for Class B felony conspiracy to commit robbery, 20 years with all but two years suspended for Class Afelony accomplice to robbery, and Class Cfelony felonious restraint. Those sentences will run concurrent to each other but consecutive to the sentences in the burglary case.

The sentences were based on a recommendation from Burleigh County Assistant State's Attorney Julie Lawyer. Lawyer also requested that the matter of restitution in the burglary case remain open for 30 days.

Long and co-defendant Jeff Brown Otter, 17, have admitted to forcing two women to drive them from a Bismarck hotel to a location in south Bismarck on Sept. 28 before making the women get out of the vehicle and run. The women reported a shot was fired from behind them while they ran. Long and Brown Otter admitted stealing firearms and other property from a Bismarck home during a burglary on Sept. 17.

Brown Otter also pleaded guilty to charges related to a Sept. 27 robbery at a Bismarck Subway. Reich sentenced him to serve 10 years in prison for 10 charges on Feb. 28.

Long and his appointed defense attorney, Todd Schwarz, painted Brown Otter as the lead culprit in the burglary and the carjacking and Long as "someone who was just following along with Mr. Brown Otter." Long was a lookout during the burglary and a reluctant accomplice during the carjacking, Schwarz said.

"He didn't think he could leave" during the carjacking, he said.

Schwarz asked Reich to sentence Long to concurrent two year sentences for the burglary and robbery. Two years would be enough time for Long to get his GED and complete treatment programs in prison, Schwarz said.

"This can turn things around," he said. "This can change things for him."

Schwarz said Long was cooperative with law enforcement and directed them to the shotgun used by Brown Otter in the crimes.

"He did not want some young kid finding this gun and ending up in an even worse situation than he was in," he said.

Long apologized to the victims of his crimes and to the people of Bismarck for "jeopardizing their safety."

"I want to apologize to the victims for what happened to them,"he said, also asking for their forgiveness. "That comes deep from my heart."

Reich said he felt Lawyer's recommendation was sufficient, adding that a probation officer that conducted a presentence investigation had recommended Long serve six years in prison.

The judge said he appreciated Long's efforts to cooperate with law enforcement and hopes he can turn his life around.

"However, the charges against you are very serious charges,"he said.

He also disputed that the crimes were the result of being in the wrong place at the wrong time with Brown Otter.

"This wasn't a single, impulsive act," Reich said.
