Man pleads not guilty to drug charges

A Bismarck man has pleaded not guilty to possession of marijuana with intent to deliver.

Rory Braunberger, 24, entered the not guilty plea to the Class Bfelony following a short preliminary hearing in which Bismarck Police Det. Paul Olson testified that officers had found more than 7 pounds of marijuana in Braunberger's home.

Braunberger also pleaded not guilty to possession of drug paraphernalia, a ClassAmisdemeanor.

Olson said, under questioning by Burleigh County Assistant State's Attorney Lloyd Suhr, that he had obtained a search warrant for Braunberger's residence in the mobile home park at 1119 South University Drive on May 1. He said Braunberger and two other people lived in the mobile home.

One of the other residents, Jennifer Schreiner, also has been charged with possession of marijuana with intent to deliver and possession of drug paraphernalia. She is slated to appear at a preliminary hearing on the matter on July 23.

The other resident of the home has not been charged, Suhr said after the hearing.

"At this time, the evidence pointed toward these two,"he said.

Olson said 6 pounds of marijuana, packaged in three 2-pound bricks, was found under a dresser in the bedroom shared by Braunberger and Schreiner. Another brick, which weighed 1 pound and 2 ounces, was found in a living room cabinet, he said.

Officers also found two scales, which tested positive for marijuana residue at the state crime lab, Olson said.

He said the quantity of drugs in the home paired with the scales indicate a drug delivery operation.

Braunberger's attorney, Ralph Vinje, asked why Olson did not believe the marijuana was for personal use.

"It would take an awful long time to smoke 7 pounds of weed," Olson said.
