A high-risk sex offender from Bismarck has been located and arrested in Fort Yates.
Roger McAvoy, 47, was charged Friday with failure to register as a sex offender.
South Central District Judge Sonna Anderson set bond for McAvoy at $20,000 cash, at the request of Burleigh County Assistant State's Attorney Jeff Ubben.
According to court documents, McAvoy pleaded guilty on Dec. 10 to a separate charge of failure to register as a sex offender. Anderson sentenced him to five years with 225 days suspended and credit for 75 days served.
On Dec. 12, McAvoy registered an address of 521 W. Indiana Ave. with Bismarck police. Officers learned during a routine check on Dec. 24 that McAvoy no longer lived in the apartment he registered.
Police asked for the public's assistance in locating McAvoy on Thursday. Friday, Sandy Luger of Fort Yates called the Sioux County Sheriff's Department after someone pointed McAvoy out to him.
"I don't need someone like him around here,"Luger said. "I've got a 12-year-old granddaughter."
Sioux County State's Attorney John Gosbee said Sheriff Frank Landeis arrested McAvoy in Sioux Village while McAvoy was working on a vehicle on the side of the road. McAvoy was booked into the Burleigh County Detention Center around 1 p.m.
In court Friday, McAvoy told Anderson he was "appalled" at being charged.
"For the record, I did register," McAvoy told the judge. "I talked to my probation officer last night and he didn't say anything about this."
Anderson asked McAvoy for his current address, which he maintained was 521 W. Indiana Ave.
If McAvoy posts bond, he will have to have proof of a lease or have written permission to stay at a local address before he will be released, Anderson ordered. He is prohibited from leaving Burleigh or Morton counties.
McAvoy was convicted in Burleigh County in 1989 of gross sexual imposition for having a sexual relationship with a 12-year-old girl. He was sentenced to four years in prison. He was convicted in 1995 in Arapahoe County, Colo., of sexual assault on a child for groping and pinching 13- and 14-year-old girls while at a skating rink. He was sentenced to 90 days in jail and eight years of probation.
