Charette trial resumes today

After a weekend break, activity resumes today in the fourth-floor courtroom of the Burleigh County Courthouse for the fifth day of the Waylon Charette murder trial.

The state rested its case Friday against the 22-year-old Driscoll man accused of murdering and molesting 73-year-old Marion Swenning, of Driscoll, and burglarizing her home and the home of another Driscoll resident. The jury trial before South Central Judge Thomas Schneider is scheduled to last two more days.

During a break in Friday's court proceedings Charette's attorney, Kent Morrow, said that he plans to call six witnesses to testify on behalf of the defense. The defense's strategy is to prove that Charette has an alibi, and couldn't have been at Swenning's home at the time of her death, according to Morrow's opening argument on Tuesday.
