Man sentenced in rape

A Bismarck man who admitted to raping a classmate has been sentenced to time served.

South Central District Judge Tom Schneider sentenced Marcus Bartole to five years in prison with all but time served suspended and five years of supervised probation. The sentence was part of a binding plea agreement reached by prosecutors and Bartole's defense attorney Steve Balaban.

Bartole has admitted to forcing a woman to have sex when they were working on a project at her home on Oct. 22, 2007.

Bartole had been charged with Class AA felony gross sexual imposition because of allegations of force. A reduced charge, filed Sept. 4, said he used threats of force in the attack. He pleaded guilty to the reduced charge, Class B felony sexual imposition, on Sept. 4.

Burleigh County Assistant State's Attorney Julie Lawyer said the victim in the case was aware of the plea agreements and had consented to the plea agreement.

Bartole is prohibited from using alcohol or contacting the victim while he is on probation.He also must complete sex offender treatment and register as a sex offender.

Bartole spent about four months in jail on the charge in all. He was in jail from Oct. 23, 2007, to Dec. 24, 2007, before posting bond. Then, he was returned to jail Oct.16 after a probation officer doing a presentence investigation in the case was unable to contact him. He has been held without bond in the Burleigh County Detention Center since then.
