Three brothers arrested following scuffle

Christmas Eve did not get off to too good of a start for one Bismarck family when three brothers were arrested following a morning scuffle.

Bismarck Police Sgt. Dwight Offerman said officers responded to a fight call at 7:07 a.m. Wednesday and ended up arresting three brothers, including the one who was the alleged victim in the fight.

Offerman said the oldest brother, Josiah Himes, was accused of striking the youngest brother, Dylan Himes, in the head with a shotgun. The middle brother, Jaret Himes, was accused of biting Dylan Himes.

Dylan Himes was treated for injuries, then arrested on an outstanding warrant.

Josiah Himes, 23, was charged Friday in South Central District Court with aggravated assault, a Class Cfelony, and possession of drug paraphernalia, a Class A misdemeanor. South Central District Judge Gail Hagerty set bond for him at $5,000 cash, prohibited him from being within 1,000 yards of or contacting Dylan Himes, and prohibited him from using alcohol.

Jaret Himes, 22, was charged Friday in Bismarck Municipal Court with simple assault, a Class Bmisdemeanor. He was released from custody after appearing in court Friday morning and is scheduled for a court trial on Jan. 12 before Judge William Severin.

Dylan Himes, 20, was arrested on a warrant with a $500 bond out for failure to appear, Offerman said.
