Couple pleads guilty to drug charges

A Bismarck couple has pleaded guilty to a list of felony drug charges.

Darcy James Wentz, 56, pleaded guilty on Sept. 21 to three Class A felony charges of delivery of cocaine, one Class Afelony charge of possession of cocaine with intent to deliver, one Class C felony charge of possession of drug paraphernalia and one Class Amisdemeanor charge of possession of drug paraphernalia, according to court documents.

Prosecutors dropped seven Class C felony counts of possession of drug paraphernalia and one Class B misdemeanor charge of possession of marijuana in exchange for the guilty pleas, Burleigh County Assistant State's Attorney Cynthia Feland said.

Donna Joyce Eggen, 54, pleaded guilty on Sept. 21 to Class Afelony possession of cocaine with intent to deliver, Class C felony possession of drug paraphernalia and Class Amisdemeanor possession of drug paraphernalia, according to court documents.

Prosecutors dropped five Class C felony counts of possession of drug paraphernalia in exchange for the pleas, Feland said.

Wentz's attorney, Tom Dickson, said Wentz will be sentenced to up to one year in prison under a binding plea agreement presented to South Central District Judge David Reich.

"Darcy wanted to accept responsibility for what he has done," Dickson said Tuesday.

A receptionist for Michael Hoffman, Eggen's attorney, said Hoffman was working on a brief for the state Supreme Court and was not available for comment Tuesday afternoon.

Wentz and Eggen pleaded guilty at a hearing originally scheduled for the purpose of debating evidence suppression motions made by the defense attorneys. Feland said the hearing time was used for change of plea hearings since plea agreements were reached in the case. Dickson and Hoffman dropped the suppression motions when the plea agreements were reached, she and Dickson said.

Police said the charges against Wentz and Eggen, who are married, were the result of an investigation conducted by officers since August 2006.

Search warrants were executed simultaneously in February at Wentz Auto Center Inc., 1102 Airport Road, and the couple's residence on the 300 block of Ashwood Drive.

Officers found drug paraphernalia at Wentz Auto Center Inc. Wentz was a co-owner of the car dealership, but has sold the business. Wentz was arrested at the dealership.

Officers found 19 grams of cocaine, which were individually packaged, at the residence. Eggen was arrested at the home.

According to court documents, the delivery of cocaine charges against Wentz come from incidents on Aug. 9, Oct. 18 and Jan. 19, when he sold cocaine to individuals.

Wentz and Eggen are free upon posting cash bonds of $50,000 and $10,000, respectively.
