The sex offender who attended a recent Mandan football game won't be able to attend any more games.
The Mandan School Board approved a policy restricting when and where sex offenders can come onto school property at its regular school board meeting Monday.
"We had an individual at the football game, and we couldn't do anything," Superintendent Wilfred Volesky said. If the district had a policy in place that did not allow convicted sex offenders on school property, they could have had the individual removed, he said.
This was the latest issue the district has had to consider in drafting a policy regarding sex offenders on district property. North Dakota Century Code makes it a class A misdemeanor if a sex offender is at a school for reasons other than voting or attending a public meeting, unless they are a parent and have permission from the school board to be there. Century Code applies to people found guilty of class A misdemeanor or felony sexual offenses against a minor, or people required to register as a sex offender.
Faris Field is district property but not a school building. The board, when considering the policy on Monday, decided to make the policy apply to all district property.
The policy, which was approved unanimously, gives sexual offenders permission to enter schools to vote or attend public meetings. Rights are expanded for sexoffenders who are parents, board member Kirsten Baesler said.
Parent sex offenders cannot drop their children off on school property. The policy wants children dropped off in a public right-of-way that provides safe access to school. The parent can only transport their own children.
Extracurricular events, academic meetings and other school events require 72-hour notice to ask permission to attend.
"They will not be allowed to attend any extracurricular activities," Volesky said.
Meetings with teachers, such as for individual education plans, would be arranged off school property, he said.
If it comes to the attention of the district that a parent is a sex offender, a letter will be sent with the policy. This doesn't mean sex offenders can claim ignorance and show up on school grounds. The policy addresses this as well.
The Bismarck School District will be considering a sex offenders policy at an upcoming meeting. It will use the North Dakota School Board Association policy as a template, which is what the Mandan School District used.
The board also approved a policy for architect selection that follows the Century Code for bidding procedures, and the district's policy on local purchasing, which gives preference to local businesses.
