Man gets suspended sentence

A Fargo man has received a suspended sentence for possession of methamphetamine with intent to deliver.

David Lindbo, 21, pleaded guilty Tuesday to the Class A felony as well as Class C felony possession of drug paraphernalia.

South Central District Judge Tom Schneider sentenced Lindbo to a 10 years, all suspended, with three years of supervised probation for the Class A felony. The judge gave Lindbo a three-year suspended sentence for the Class C felony. The sentence was a joint recommendation of Burleigh County Assistant State's Attorney Julie Lawyer and Lindbo's appointed defense attorney Steve Balaban.

Lindbo also will have to forfeit the vehicle he was driving when he was arrested as a condition of probation and will have to pay court fees.

Lindbo was stopped at the intersection of East Divide and East Bismarck Expressway by a Burleigh County sheriff's deputy for an equipment violation at 1:40 a.m. Feb. 24. Lindbo gave the deputy who pulled him over consent to search the vehicle, and the deputy found methamphetamine and drug paraphernalia in the car.

Lawyer said Lindbo, who was on probation for a 2006 felony possession of drug paraphernalia conviction, was given a drug test by his probation officer following his arrest, and he tested positive for methamphetamine. She said Lindbo told officers he sometimes sold marijuana and methamphetamine to friends.

Lindbo was sent back to prison on probation violations in February and was released from custody on Aug. 18.
