Investigation goes on in BB gun incident

Bismarck police are continuing to investigate an incident where an 8-year-old boy was shot in the back with a BB.

The BB lodged in the boy's back, and he was taken to a hospital after the incident Saturday night.

Sgt. Dwight Offerman said police are following up on leads in the case.

Offerman said a boy who a neighbor had reported to have seen with a BBgun was not involved in the shooting. The neighbor had reported seeing the boy shooting at a barking dog, but later clarified that incident was several years earlier, he said.

The boy was not in town on Saturday, Offerman said.

Bismarck city ordinance prohibits the firing of firearms within city limits. A separate ordinance also prohibits people from firing BB guns, air rifles, pellet guns or CO2 guns in city limits. Carrying those items in a vehicle while they are loaded also is prohibited.

The ordinances do not apply to law enforcement, citizens defending persons or property, or participants in lawful activities, such as at indoor target ranges or as part of educational or gun safety classes.
