Boy cited after reporting assault

A Hazen boy was cited for being a minor in consumption and curfew violation after reporting he was attacked in south Bismarck.

The boy said he was attacked outside a southwest Bismarck apartment after attending a party there, Lt. Randy Ziegler said.

He said the boy was treated and released at a Bismarck hospital for cuts and a broken nose. The boy told police one of the three assailants used a golf club during the alleged attack, Ziegler said.

He said the assault remains under investigation.

" If he wasn't drinking and wasn't out past curfew, he wouldn't be charged with any crimes. Him being attacked is a whole other issue. Victim? How do we know he didn't start the fight, got his butt kicked, and then just reported that he was attacked? Let the investigators do their jobs before starting to ask why this and why that. "

" Why is this boy being charged with a crime? Yes he violated the law but this just discourages victims from reporting crimes. If he doesn't report the assault for fear of being charged then the assailants get away with a much more serious crime than minor in consumption. "
