Oral arguments are set before an 8th U.S. Circuit Court of Appeals panel in the case of two North Dakota farmers who want to grow industrial hemp.

David Monson and Wayne Hauge are appealing a federal judge's dismissal of a lawsuit they filed against the federal government, which regulates the crop as a drug.

Hauge and Monson obtained state permits to grow hemp, which can be used in a variety of products, but were blocked from growing it by the federal Drug Enforcement Administration. They argue in their appeal that hemp is not a substitute for its cousin, the illegal drug marijuana.

The oral arguments are scheduled Nov. 12 in St. Paul, Minn. Vote Hemp, a nonprofit advocacy group, is funding the farmers' legal battle.

" I can't believe we [The People] are still waiting for the feds to give back what they had no right to take in the first place! Has anyone raised the issue that the Drug Enforcement Agency simply has no jurisdiction since hemp in not a drug? I say "PLANT BABY, PLANT!" Tell the Governor to enforce the Laws of the State and send Troopers to your farm for protection from the DEA Gestapo. "

" Industrial Hemp really gets a bad name... Research (mostly from other countries) shows that the industrial grade hemp simply cannot produce enough of the dreaded THC molecule to produce any psychotropic effect. Research also indicates that the oils- both the fatty oil from the mature seed- or the essential oil from harvest and distillation of leaves and flowers before seed maturity are healthy and possess therapeutic capability. The ability to import seed is inadequate for nutrition purposes as the oils in the seed deteriorate if not pressed soon after harvest. Best nutrition and taste will come from oil produced from fresh harvest. In addition, history and industrial science shows that many industrial products can be made from hemp (like plastics, insulation, and more,) hemp is fairly pest resistant (good for environment.) Let's get states rights back! "
