N.D. Supreme Court rejects farmer's bond claim

North Dakota's Supreme Court says two farmers cannot be paid from a bond claim for barley they sold to a Minnesota grain company.

The Minnesota Grain company went broke in April 2007. It had elevators in southwestern North Dakota and in East Grand Forks, Minn.

Jim Broten and his son Eric farm near Dazey in eastern North Dakota. They sold more than $300,000 worth of barley to the East Grand Forks elevator.

Minnesota Grain's North Dakota elevator had a $100,000 bond. When Minnesota Grain went broke, the Brotens asked for money from the bond. They were refused because the Brotens delivered their grain out of state.

The Supreme Court ruled that the East Grand Forks elevator was not covered by the North Dakota bond.
