Preliminary hearing delayed for Gibbs

FARGO (AP) - A preliminary hearing for a former Barnes County jailer charged in a 2004 rape here has been delayed.

Moe Gibbs is charged with Class A felony gross sexual imposition in the rape of a 22-year-old woman on July 27, 2004.

The hearing, originally scheduled for Wednesday, was delayed a second time. Court documents indicate the latest delay is so attorneys have more time to go over DNA evidence. A new date was not immediately set.

Gibbs was linked to the unsolved rape by DNA, officials said, after voluntarily submitting a sample before his arrest on a murder charge in the Sept. 13 death of Valley City State University student Mindy Morgenstern, 22, of New Salem.

Gibbs is scheduled for trial in Morgenstern's death in June in Minot.

" Where is Al Sharpton, Jesse Jackson and the Black Panthers saying and demonstrating that this guy is innocent? Come on guys you already tried and found the Duke boys guilty so stands to reason this guy is innocent. 88 Duke professors signed petition condemning those Duke LaCrosse players so if 88 liberal professors say their guilty along with Sharpton, Jackson, and Black Panthers they must be guilty of rape. Question to those 88 professors where's your petition for the guy here in North Dakota? You just gotta love liberal democrats. "
